The Firm is currently serving as lead counsel to Major League Soccer (“MLS”) in an antitrust suit brought by the North American Soccer League (“NASL”) against MLS and co-defendant, U.S. Soccer Federation (“U.S. Soccer”), following US Soccer’s decision not to sanction NASL as a Division II professional league for the 2018 season. NASL alleges that MLS and U.S. Soccer are engaged in an antitrust conspiracy to ensure that MLS is the sole Division I soccer league in the United States, and further alleges that MLS is an illegal monopoly in violation of the Sherman Act. Following more than three years of fact and expert discovery, all three parties moved for summary judgment. There has been no decision to date, and a trial has been scheduled for early 2025.
Proskauer also secured a landmark victory for Sanderson Farms in a blockbuster broiler chicken antitrust conspiracy case, one of the largest-ever antitrust jury trial wins involving the U.S. agriculture industry. Following a six-week trial, a jury in the U.S. District Court for the Northern District of Illinois delivered a full defense verdict, rejecting the Plaintiffs’ claims that alleged that Sanderson Farms participated in a supply reduction conspiracy with other producers in the broiler industry between 2008 and 2012.
The team previously secured a full defense win for Gilead Sciences, Inc. in a $3.6 billion antitrust case on allegations that the pharmaceutical company struck an anticompetitive "pay-for-delay" patent settlement related to two of its HIV medications following a six-week trial. The verdict is only the third ever in reverse payment cases of this type, and the first ever to find for the defense on grounds of both the absence of a payment and the absence of market power for the brand in the relevant market.
