Kieran Murphy is a partner in Proskauer’s Real Estate Department and a member of our Real Assets and Hospitality, Gaming & Leisure Groups. Kieran has a wide-ranging practice and represents investors, lenders and other stakeholders in complex transactions with a nexus to real estate.

Kieran has extensive experience representing private equity firms, hedge funds and other providers of private capital in connection with both debt and equity investments in real assets. He regularly represents debt funds originating, acquiring and participating in mortgage and mezzanine loans, as well as private equity funds and companies investing in real estate through joint ventures. Kieran’s expertise spans all major asset classes within real estate and includes various different types of transactions such as sale-leasebacks, large portfolio acquisitions and sales and, more recently, digital infrastructure.

Throughout his career, Kieran has been noted for his ability to deftly navigate bespoke and first-of-their-kind transactions for his clients. A prime example was his representation of the lenders to JCPenney in their acquisition, through a liquidating trust, of 166 retail stores and distribution centers and the leaseback of such properties to the restructured operating company (i.e., JCPenney), which was simultaneously acquired by affiliates of Simon Property Group and Brookfield Properties. The sale-leaseback was the most complicated and challenging transaction of its type in recent memory and culminated in eight (8) days of round-the-clock mediation through the bankruptcy court. Kieran is currently the chief outside real estate counsel to the liquidating trust. Through his attention to detail, creativity and commerciality, Kieran focuses on closing deals efficiently and collegially while vigorously protecting his clients’ interests.

Kieran received his Bachelor of Arts in English Literature from Washington and Lee University and his Juris Doctor from Fordham University School of Law. Kieran lives in Manhattan with his wife.
