David A. Picon

David A. Picon is a partner in the Litigation Department and co-head of the Private Credit Litigation Group. A seasoned litigator and counselor, David has tried dozens of cases in various tribunals for financial services firms and public and private companies.

David represents a diverse range of lenders, including revenue-based financing companies, providing counsel in litigation, regulatory and counseling matters. He advocates for lenders, statutory and ad hoc committees in large Chapter 11 cases in bankruptcy courts throughout the country, handling the full spectrum of contested and adversary proceedings. Additionally, David advises prominent healthcare companies and their sponsors in complex contractual and employment-related disputes. His extensive experience also includes advising on general commercial matters.

David is a frequent speaker on financial services industry topics and co-authored “Broker-Dealer Litigation and Arbitration,” Chapter 86 of the multi-volume treatise, Commercial Litigation in New York State Courts.  He also regularly speaks on revenue-based financing matters and was the inaugural recipient of the Alternative Finance Bar Association’s Greg Nowak Impact Award, for his contributions to the legal community both on matters of law and beyond.

David is the co-chair of the Firm’s New Business Committee, immediate past chair of the Firm’s Billing and Collections Committee, and a member of the Firm’s Hiring Committee and Pro Bono Committee.

At the request of Chief Judge Rowan D. Wilson, David serves as a member of the New York State Permanent Commission on Access to Justice. He is also the President of the Board of Trustees of JVS of MetroWest.
